Simple stalking occurs when an individual deliberately, repeatedly and with malice follows or harasses another person. The harassing can occur face to face, by telephone, through cyberspace, or anywhere and any way a person can be contacted. To rise to the level of aggravated stalking, the offense must contain at least one of these elements:
- Credible threats with the intent to make someone in reasonable fear of death or bodily injury
- Stalking a minor under 16 years of age
- Stalking a person after a violation of restraining order or any court imposed ban of conduct
